The Arizona Department of Real Estate (ADRE) and Office of Administrative Hearings (OAH) handle many HOA disputes. Here's an overview of the process.
ADRE Complaints
- Homeowners can file complaints against HOAs for violations of A.R.S. Title 33
- ADRE investigates and may refer to OAH for a hearing
- Common complaint areas: records access, open meetings, election procedures, assessment issues
- There is no filing fee for ADRE complaints
- You do NOT need an attorney to file (though it may help)
OAH Hearings
- Administrative hearings are less formal than court but still follow rules of procedure
- An Administrative Law Judge (ALJ) presides
- Both sides present evidence and testimony
- The ALJ issues a written decision
- Decisions can be appealed to Superior Court
