Terms of Use & Community Agreement

Welcome to the AZ HOA Attorney Community Forum (the "Forum"), operated by Hound LLC ("we," "us," or "our"). By registering for and using this Forum, you agree to be bound by the following terms. If you do not agree, do not register or use this Forum.

Age Requirement

You must be at least 18 years of age to register for and use this Forum. This Forum discusses legal matters, government proceedings, and real-world disputes involving adults. By registering, you confirm that you are 18 years of age or older. Accounts found to belong to individuals under 18 will be terminated.

1. User-Generated Content

All posts, comments, and content on this Forum are created by individual users and represent their personal opinions and experiences only. User posts do not represent the views, opinions, or positions of Hound LLC, the Arizona HOA Transparency Project, or any affiliated entity. We do not endorse, verify, or guarantee the accuracy of any user-generated content.

2. Not Legal Advice

Nothing posted on this Forum constitutes legal advice. The Forum is a community discussion platform for sharing experiences and information about HOA governance in Arizona. You should consult a licensed attorney for legal advice specific to your situation. No attorney-client relationship is created by posting on or reading content on this Forum.

3. Prohibited Conduct

You agree NOT to post content that:

• Is defamatory, libelous, or knowingly false
• Constitutes harassment, threats, or intimidation of any individual
• Contains personal private information (home addresses, phone numbers, Social Security numbers, financial information) of any individual without their consent
• Infringes on copyrights, trademarks, or intellectual property rights
• Is obscene, hateful, or discriminatory
• Constitutes spam, advertising, or commercial solicitation
• Violates any applicable federal, state, or local law
• Impersonates another person or entity
• Interferes with the operation of the Forum or other users' enjoyment of it

4. Your Responsibility

You are solely responsible for the content you post. You represent and warrant that your posts are truthful to the best of your knowledge, that you have the right to share the content, and that your posts do not violate any law or the rights of any third party.

5. Indemnification

You agree to indemnify, defend, and hold harmless Hound LLC, its owners, officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Forum, your posts, or your violation of these Terms.

6. Content Removal & Account Termination

We reserve the right, but are not obligated, to:

• Remove, edit, or refuse any content at our sole discretion
• Suspend or terminate any account for violations of these Terms
• Cooperate with law enforcement or legal processes as required

If you believe content violates these Terms, please use the "Report Post" feature or contact us.

7. Notice and Takedown

If you believe that content posted on this Forum is defamatory, infringes your rights, or is otherwise unlawful, please notify us promptly at admin@azhoawatch.org with sufficient detail to identify the content. We will review and act on such notices in good faith.

8. Disclaimer of Warranties

THE FORUM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE FORUM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL LIABILITY FOR USER-GENERATED CONTENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOUND LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE FORUM.

10. Governing Law

These Terms are governed by the laws of the State of Arizona. Any disputes shall be resolved in the courts of Maricopa County, Arizona.

11. Privacy

Your use of the Forum is also governed by our Privacy Policy, available on the Forum. We collect only the information necessary to operate the Forum (email, IP address, username). We do not sell your personal information.

12. Modifications

We may update these Terms at any time. Continued use of the Forum after changes constitutes acceptance of the modified Terms.
