ADRE Complaints & OAH Hearings — How It Works

The Arizona Department of Real Estate (ADRE) and Office of Administrative Hearings (OAH) handle many HOA disputes. Here's an overview of the process.

ADRE Complaints
  • Homeowners can file complaints against HOAs for violations of A.R.S. Title 33
  • ADRE investigates and may refer to OAH for a hearing
  • Common complaint areas: records access, open meetings, election procedures, assessment issues
  • There is no filing fee for ADRE complaints
  • You do NOT need an attorney to file (though it may help)

OAH Hearings
  • Administrative hearings are less formal than court but still follow rules of procedure
  • An Administrative Law Judge (ALJ) presides
  • Both sides present evidence and testimony
  • The ALJ issues a written decision
  • Decisions can be appealed to Superior Court
