Judgment Creditor North Canyon Ranch Owners Association filed a Petition Requiring
Garnishee to Appear regarding Garnishee Scott Exclusive Stone and Tile, LLC. Judgment
Creditor seeks an award of attorney fees in an amount not less than $250.00 in its Petition.
In order to hear argument as to whether the Court can award attorney fees prior to hearing
from the Garnishee at an Order to Show Cause hearing, the Court sets the Petition for oral
argument.

IT IS ORDERED that the non-exempt earnings of the Judgment Debtor, Dustin Scott,
withheld by the Garnishee, Scott Exclusive Stone and Tile LLC., after Service of the Writ of
Garnishment shall be transferred to the Judgment Creditor in an amount not to exceed 15% of the
Judgment Debtor’s disposable earnings.
IT IS FURTHER ORDERED that any non-exempt earnings withheld in excess of 15%
shall be refunded to the Judgment Debtor.
IT IS FURTHER ORDERED the garnishment is a continuing lien against the non-exempt
earnings of the Judgment Debtor and subject to the 15% limitation set forth above.
Counsel for the Judgment Creditor shall submit a proposed form of Order for Continuing
Lien for the Court’s review and signature within ten days hereof.

A formal Order of Continuing Lien, all in accordance with the above, is signed by the
Court on May 10, 2013 and filed (entered) by the clerk on May 10, 2013.
ALERT: The Arizona Supreme Court Administrative Order 2011-140 directs the Clerk's
Office not to accept paper filings from attorneys in civil cases. Civil cases must still be initiated
on paper; however, subsequent documents must be eFiled through AZTurboCourt unless an
exception defined in the Administrative Order applies.
