The Court considered the Motion for alternative service filed by Plaintiff M&T Bank
(“Plaintiff”). Plaintiff seeks to serve Defendant Karen Jolley (“Defendant”) by alternative
means. Pursuant to Rule 4.1(k) Ariz.R.Civ.P., the Court may grant a Motion for alternative
means of service if personal service is impracticable and the Plaintiff has been diligent. Such a
motion must be supported by an affidavit that sets forth the serving party’s reasonably diligent
efforts to serve the person.
Plaintiff’s motion establishes that Plaintiff has been diligent and that service by
alternative means is the most practicable means of service. The Court notes, however, that
Defendant seeks to mail and post the documents to be served at the last known address for
Defendant—the address on South 107th Street in Mesa. Plaintiff, however, found another
address for Defendant—on Karen Lane in Gilbert—and was told by a resident at that address
that Defendant no longer resides there. The Court is ordering Plaintiff to mail the documents to
that address, in addition to mailing and posting them to the South 107th Street Mesa address.

IT IS ORDERED granting the motion for alternative service. Plaintiff shall serve
Defendant by mailing and posting a copy of the pleadings to the 2626 South 107th Street, Mesa,
AZ address. Plaintiff shall also serve Defendant by mailing and posting a copy of the pleadings
to the 1170 S. Karen Ln. Gilbert, AZ address.

To further clarify and specify, the paragraph shall read:

IT IS FURTHER ORDERED that all documents necessary to support the entry of a
default judgment must be either e-filed or filed in paper form.
Pursuant to the Maricopa County eFiling Guidelines, section 2.09, attorneys shall
electronically file all the documents required to request a default judgment, such as the
Application for Entry of Default, Motion for Entry of Default Judgment, Sum Certain Affidavit,
Application for Attorneys’ Fees when appropriate, and Statement of Costs.
Self-represented litigants are exempt from any mandatory eFiling requirements but may
eFile if they prefer.
Attorneys and Self-Represented Litigants must submit a default judgment packet required
by the Court, including the documents identified on the default judgment packet coversheet in
paper to the assigned commissioner’s division.
A Commissioner will not act upon a Motion for Entry of Default Judgment until the
default judgment packet with all the required documents has been received by the division
in paper form.
If the paper packet is not received by the above-named Commissioner division by July
28, 2026, the matter will be dismissed without prejudice for lack of prosecution as to the
defaulted party.
