The Court has considered Plaintiff's December 15, 2025 Motion for Sanctions Against
Shannon Plessel and Crown Point HOA and Order to Show Cause Regarding False Filings and
Wrongful Foreclosure Attempts; Defendant Crown Point HOA's January 2, 2026 Response; and
Plaintiff's January 5, 2026 Reply.
Shannon Plessel is not a party to this case, and any claim for sanctions against her
personally is inappropriate. As to Defendant Crown Point, the motion assumes that the factual
allegations of the Complaint are true, but no motion for summary judgment has been filed by
Plaintiff or granted on any factual issue. The motion is not in the form of a motion for summary
judgment.
Finally, Plaintiff failed to properly serve the motion on Crown Point. Defendant's counsel
did not agree to be served electronically. By Plaintiff's own statement, Defendant's counsel agreed
to serve Plaintiff electronically.

sanctions at this time. Further, given that there has been prior litigation concerning HOA lien
foreclosures, claim preclusion or issue preclusion may apply, but the Court does not have a record

Restraining Order. Plaintiff cannot identify an actor who committed the alleged vandalism,
therefore there is no one for the Court to restrain.

The Court has considered Defendant Crown Point Homeowners Association's January 16,
2026 Motion to Dismiss Pursuant to Rule 12(B)(1), (6); Plaintiff's January 20, 2026 Response; and
Defendant's January 28, 2026 Reply.
Plaintiff has pending a case involving the same property and the same assessments in
CV2023-013780. In that case, the Association is seeking to recover unpaid assessments. The case
is pending trial.
The subject matter in this case is a mandatory counterclaim that should have been raised in
CV2023-013780. The Court will not opine on whether these claims are moot in that case.
IT IS ORDERED granting the motion to dismiss.
This matter is now dismissed in its entirety as there are no remaining Defendants. All
pending motions are moot.

Pursuant to the Maricopa County eFiling Guidelines, section 2.09, attorneys shall

Self-represented litigants are exempt from any mandatory eFiling requirements but may

by the Court, including the documents identified on the default judgment packet coversheet in
paper to the assigned commissioner’s division.

If the paper packet is not received by the above-named Commissioner division by

The Court has considered Defendants Mulcahy's November 24, 2025 Motion to Dismiss;
Plaintiff's December 5, 2025 Response; Defendant Crown Point Homeowners Association's
December 11, 2025 Joinder in the Motion; and Defendants Mulcahy's December 10, 2025 Reply.
No oral argument is necessary.
Plaintiff's claims against the Mulcahy Defendants are barred by the litigation privilege. The
Mulcahy Defendants were acting in the course and scope of their representation of Crown Point
Homeowners Association.
In addition, the fraud claims are not plead with specificity.
Any claims of bankruptcy violations are not within the jurisdiction of this Court.
Crown Point Homeowners Association's Joinder is inappropriate because many of the
defenses alleged do not apply to them.
