The Court has received Blackstone at Vistancia Community Association’s Application for
Distribution of Excess Proceeds Deposited with Treasurer, filed May 1, 2025, by counsel for
Respondent/Applicant.
IT IS ORDERED THAT:
Applicant shall immediately file a Certificate of Compliance with all service
requirements as required by A.R.S. § 33-812(G).
Upon the expiration of the deadline for interested parties to file a response to
the Application under A.R.S. § 33-812(I), Applicant shall either: (1) request a
hearing if there are competing claims to the proceeds; or (2) file a notice of
lodging and lodge an appropriate form of order for release of the proceeds.
If there exists any apparent lien, encumbrance or interest that could have
priority over Applicant, Applicant shall acknowledge the existence of such

Upon this Court’s own motion, this Court is scheduling this Excess Proceeds matter
under A.R.S. § 33–812 for argument. At this oral argument, this Court will hear argument about
the legal basis for the parties’ priority and the proper disposition of the funds in question. This
Court encourages the parties to meet and confer prior to the scheduled argument to come to a
mutual agreed upon resolution if such a resolution is possible.
Further, this Court finds pre-hearing briefing is helpful. The parties are encouraged to
file a brief, no longer than 10 pages, that outlines their party’s legal position and why it is
entitled to the relief it is seeking. Such pre-hearing briefing should be filed no later than 1 week
prior to the oral argument and served upon the other parties.
IT IS ORDERED setting a virtual Oral Argument Hearing on December 5, 2025 at
4:00 p.m. (time allotted: 30 minutes) in this division.
