The Court has reviewed Plaintiff’s Application for and Affidavit on Entry of Default, filed
September 27, 2023, as well as the docket in the case.
On July 25, 2023, the Court entered an Order Allowing Motion for Extension of Time to
Serve Verified Complaint, which granted Plaintiff until September 4, 2023 to obtain service on the
Defendants. Based on a review of the docket, no additional motions requesting an extension of
time were filed.
On August 24, 2023 Plaintiff filed a Certificate of Service, which indicated service was
completed “…via email and certified mail, return receipt requested”. Upon review of the docket,
no motion for alternative service requesting leave to serve by email was filed in this matter.
Further, no verification or proof of sending, or receipt, of certified mail is included with the

pursuant to the July 25, 2023, Order Allowing Motion for Extension of Time to Serve Verified
Complaint.
IT IS FURTHER ORDERED deeming Plaintiff’s Application for and Affidavit on Entry
of Default, filed September 27, 2023, moot based on the dismissal.

Pursuant to the Maricopa County e-Filing Guidelines, section 2.09, attorneys shall
electronically file all the documents required to request a default judgment, such as the Application
for Entry of Default, Motion for Entry of Default Judgment, Sum Certain Affidavit, and
Application for Attorneys’ Fees when appropriate and Statement of Costs, but shall submit a
default judgment packet required by the Court, including the documents identified on the default
judgment packet coversheet in paper to the assigned Commissioner’s Division. A Commissioner
will not act upon a Motion for Entry of Default Judgment until the default judgment packet with
all the required documents has been received by the Division in paper form.
