FOR ALL IN-PERSON APPEARANCES: Due to the spread of Covid-19, the Arizona
Supreme Court Administrative Order 2021-187 and the Maricopa County Superior Court
Administrative Order 2021-169 require all individuals entering a court facility in Maricopa
County to wear a mask or face covering at all times that they are inside the facility. Any person
who refuses to wear a mask or face covering as directed by court personnel will be denied access
to the facility. If a participant is denied physical access to a courthouse for refusing to wear a face
covering, the participant must contact the assigned judicial division to determine whether the
person can participate in the proceeding using an audio or video connection.

This Court has reviewed the case file in this matter, the parties Rule 80 agreement,
Plaintiff’s Notice of Proposed Form of Judgment, and argument held before the Honorable John
Rea on April 11, 2023. After discussions regarding the parties Rule 80 agreement, and Defendant’s
claim that the documents submitted by Plaintiff contained additional provisions not contained in
the Rule 80 agreement, the Court gave Defendant until April 19, 2023, to review and submits his
“specific” objections to the language contained in the documents submitted by Plaintiff. On April
14, 2023, Defendant filed his Response to Plaintiff’s Proposed Form of Judgment. While
Defendant made some conclusory remarks pertaining to the alleged actions of plaintiff’s
“paralegal”, he did not point to any language in the submitted proposed form of order that was
contrary to the Rule 80 agreement reached by the parties.
IT IS ORDERED overruling Defendant’s Objection and affixing the Court’s signature
today’s date, May 24, 2023, to the formal proposed form of written Judgment and Decree of
Foreclosure and Order of Sale, filed (entered) by the Clerk May 25, 2023.
No further matters pending, the Court signs this Minute Entry as formal written judgment
of the Court and consistent with the Rule 54(c), Ariz. R. Civ. P.
