The Court received and reviewed the proposed Order Releasing Excess Proceeds lodged
by Claimant Monterey Point II Homeowners’ Association (the “Association”). The proposed
Order contains awards for attorneys’ fees and costs. The Association’s Application for Excess
Proceeds did not request such awards and instead characterized the amount sought as the
“principal amount.” Furthermore, there is no affidavit to support an award of attorneys’ fees or a
statement of costs. Accordingly, the Court declines to enter the proposed Order Releasing
Excess Proceeds until the requested awards of attorneys’ fees and costs are properly supported in
the record.

given to all interested parties, and (3) no objections have been made and/or any objections have
been resolved. The Court orders release of the excess proceeds to Claimant all in accordance
with the formal written Order signed by the Court on November 17, 2017, and filed (entered) by
