Counsel, Christina N. Morgan, is present on behalf of Plaintiff, Ward Jennings, who is also present. Counsel, Spenser W. Counsel, Samuel Saks, is present on behalf of Defendant, Dreamland Villa Community Club. A record of the proceedings is made by audio and/or videotape in lieu of a court reporter. LET THE RECORD REFLECT the parties have conducted settlement discussions off the record prior to today’s proceedings, and advise the Court they have reached an agreement. Counsel states the terms of the settlement agreement on the record. Mr. Saks, Counsel for Defendant Dreamland Villa Community Club, has agreed to facilitate a meeting on November 3, 2015 between the parties. Plaintiff will get any information for that meeting delivered by close of business day tomorrow, October 30, 2015. Defendant, Dreamland Villa Community Club, has agreed to pay Plaintiff, Ward Jennings, $3,500.00; wherein Plaintiff will then drop the legal action taken against all Defendants. The Court addresses the matter regarding the parties’ agreement as a Rule 80(d) agreement and advises Counsel that this is a binding agreement to be enforced by the Court. IT IS ORDERED that counsel shall submit a formal written order, consistent with the agreement and approved as to form and content by the parties, for the Court’s review and signature by December 3, 2015. IT IS FURTHER ORDERED placing this case on the Court’s Dismissal calendar for dismissal, without further notice, on January 4, 2016. Unless a settlement agreement is signed by the Court or a stipulation for dismissal is received, along with a proposed form of order, is submitted prior to that date, or the Court otherwise extends the deadline for good cause shown, all remaining claims and parties will be dismissed. 9:20 a.m. Matter concludes.
