The Court has received Defendant Cynthia M. Lorenzo’s motion entitled “garnishment of
wages”. It was filed on April 5, 2017, the same date that the Order for Continuing Lien was
signed by the Court. Ms. Lorenzo requests that the garnishment be lowered to an amount less
than 25% due to financial hardship. She is requesting clarification of the amount submitted as
owed.
IT IS ORDERED setting a garnishment objection hearing to discuss Ms. Lorenzo’s
request for a reduction in the garnishment due to financial hardship for Tuesday, May 16, 2017 at
9:00 a.m. in Courtroom 303 of the Maricopa County Superior Court, Southeast Facility, 222 E.
Javelina Ave., Mesa, AZ 85210.

If Judgment Creditor does not oppose a reduction to the garnishment due to Judgment
Debtor’s financial hardship, Judgment Creditor should submit a proposed form of order to the
Court and the Court will vacate the garnishment objection hearing.
FURTHER, Ms. Lorenzo wanted Judgment Creditor to explanation the amounts she owes
as stated in the writ. IT IS ORDERED that Ms. Lorenzo shall contact Plaintiff’s counsel
Michael McGirr at 480-833-1001 to schedule a time for both of them to discuss her balance prior
to the hearing. The parties shall go over the terms in the stipulated judgment, the incurring
interests, assessments, costs and fees, and the payments made. If the telephonic contact resolves
all her questions, the parties shall inform the court. If no discussion is held prior to the hearing,
both Plaintiff’s counsel and Defendant shall appear thirty minutes before the hearing to discuss
the matter with each other. Both must come prepare to discuss their position with the court.

A record of the proceedings is made digitally in lieu of a court reporter.
This hearing was set at the request of the Judgment Debtor Cynthia Lorenzo claiming a
financial hardship.
Plaintiff’s counsel had no objection to reducing the garnishment to the reduced minimum
rate of 15% of non-exempt disposable earnings instead of the current 25% rate. As the Court
cannot order anything below that rate without the agreement of both parties, the Court approved
the 15% reduced rate and signed the amended Order May 1, 2017.

THE COURT has received Judgment Debtor Cynthia Lorenzo’s request to change court
date due to an injury.
The only remaining issue is Ms. Lorenzo’s request for a detailed accounting of the
remaining balance owed.
IT IS ORDERED affirming Court’s previous order that Ms. Lorenzo shall contact
Plaintiff’s counsel Michael McGirr at 480-833-1001 to schedule a time for both of them to
discuss the amount still owed. The parties shall discuss and go over the terms of the judgment,
the incurring interests, assessments, costs and fees, and the payments made.
IT IS FURTHER ORDERED that Ms. Lorenzo shall make this contact within ten (10)
business days.
If, Ms. Lorenzo does not make contact with Plaintiff’s counsel within ten (10) business
days, Plaintiff’s counsel shall send a detailed explanation of the awarded assessments, fines, fees,
interest, costs and attorneys’ fees within ten (10) business days to Ms. Lorenzo.
Given these orders should satisfy Ms. Lorenzo’s information request, no further hearing
shall be set at this time.
9:42 p.m. Matter concludes.

The Court has received a second ex parte letter from Defendant Cindy Lorenzo. After the
first ex parte letter was sent, the Court filed the letter with the Clerk of Court that time only so
Plaintiff’s counsel could review it, but THE COURT REJECTED the ex parte letter and TOOK
no action upon it. The Court issued a minute entry on June 15, 2017 which reminded the parties
that it is IMPROPER for any party to send letters to the Court that have not been filed with the
Clerk of Court and/or have not been sent to the other parties and the Court would REJECT such
letters.
This time, Defendant’s letter shows that a copy of the letter was sent to Plaintiff’s counsel
and the State Bar of Arizona, but there is no indication that the letter was filed with the Clerk of
Court for Maricopa County Superior Court.
