UNDER ADVISEMENT RULING

The Court took this matter under advisement after Oral Argument was held on March 13,
2015 on Plaintiff’s Motion for Summary Judgment. The Court has considered the arguments of
the parties and the pleadings. The Court makes the following findings and enters the following
orders.

THE COURT FINDS the Defendant is the recorded homeowner of Unit 4B, located at
2524 South El Paradiso #63 in Mesa, Arizona. The Court finds the property is located within the
Lake Park Village I Home Owners Association. The Court further finds that Defendant has an
obligation under the Home Owners Association to pay all fees, costs, assessments, late fees and
attorney’s fees if she is delinquent. The Court further finds that the Association already has an
automatic lien for the Defendant’s arrearages and costs, and the Association is authorized to
foreclose on the lien. The Court finds the principal amount owed by Defendant to Plaintiff is
$15,731.08 and the lien foreclosure principal amount of $12,464.75.

THE COURT FURTHER FINDS that there are no genuine issues of material fact.

Mortgage Electronic Registration Systems, Inc. (MERS) and Pentagon Federal Credit Union
filed on April 17, 2015, (2) the signed minute entry of April 22, 2015 setting aside the Order
Confirming Entry of Default Judgment as to Defendant Pentagon Federal Credit Union, (3)

Order confirming Entry of Default of Defendant Pentagon Federal Credit Union on May 11,
2015, as well as (4) the proposed Judgment and Decree of Foreclosure and Order of Sale, which
deals with Defendant Cia Spyropoulos, MERS and Pentagon Federal Credit Union.

Upon closer review of the signed and proposed orders, it is evident that the language of
the orders is confusing even to those familiar with the case. For instance, the orders of default
judgment against MERS and Pentagon Federal Credit Union are entitled “Orders Confirming
Entry of Default”. An entry of default is not the same as an entry of default judgment. Default
judgments were granted by the court as to defendants MERS and Pentagon Federal Credit Union.
Further, because one judicial officer handled the motion for summary judgment regarding
Defendant Cia Spyropoulos and another judicial officer handled the motions for entry of default
judgment as to Defendants MERS and Pentagon Federal Credit Union, the order entering
judgment against Defendant Cia Spyropoulos should not add additional orders against the other
defendants. Each order of judgment against each defendant should include all orders against that
defendant.

THEREFORE, for good cause appearing,

IT IS ORDERED that Plaintiff shall immediately amend its orders as to MERS,
Pentagon Federal Credit Union and the proposed order as to Cia Spyropoulos. There shall be a
separate order filed addressing each defendant separately, as judgment was entered against each
defendant separately on different dates. The amended orders shall correct the titles of the orders
and reflecting the relevant hearing dates of the order as to that defendant. Each amended order
should also include the foreclosure and sheriff’s sale language as to each defendant.

IT IS FURTHER ORDERED signing this minute entry as a formal order of this Court.

The Court has received Defendant/Judgment Debtor C. Spyropoulos’ Motion to Dismiss
Action. Ms. Spyropoulous is requesting that Plaintiff/Judgment Creditor Lake Park Village I
Homeowners Association make an election between an action on debt or to foreclose pursuant
to A.R.S. §33-722. Plaintiff/Judgment Creditor has not responded.

Plaintiff did elect to foreclose on the property. See Judgment and Decree of Foreclosure
and Order of Sale against Defendant Cia Spyropoulos aka C Spryropoulos filed June 2, 2015 in
this case. Plaintiff also foreclosed on the rights of other lienholders Mortgage Electronic
Registration Systems (MERS) and Pentagon Federal Credit Union. See Amended Default
Judgment and Decree of Foreclosure and Order of Sale as to Defendant Mortgage Electronic
