MINUTE ENTRY
The Court has considered Applicant, Town Square Homeowners Association’s (the
“Association”) Application for Disbursement of Excess Proceeds and Order thereto.
Good cause appearing,
IT IS ORDERED granting the Association’s Application all in accordance with the
formal written Order on Application for Disbursement of Excess Proceeds as modified and
signed by the Court on March 26, 2013, and filed by the Clerk on March 26, 2013.
IT IS FURTHER ORDERED the proper application for attorneys’ fees was not
submitted.
THEREFORE IT IS ORDERED denying the Association’s Application for Attorneys’
Fees.
ALERT: The Arizona Supreme Court Administrative Order 2011-140 directs the Clerk's
Office not to accept paper filings from attorneys in civil cases. Civil cases must still be initiated
on paper; however, subsequent documents must be eFiled through AZTurboCourt unless an
exception defined in the Administrative Order applies.

Applicant David W. Downum filed an Application for Release of Excess Proceeds on
May 19, 2015. Applicant has now submitted a proposed form of order seeking the release of
funds. The proposed form of order is not supported by the record before the Court.
Applicant filed an Affidavit of Mailing on June 15, 2015. From a review of that
document, it does not appear that Applicant meet the mailing requirement required in A.R.S. §
33-812(G).
IT IS ORDERED denying the Application for Release of Excess Proceeds filed on May
19, 2015, for failure to comply with A.R.S. § 33-812(G). This denial is without prejudice to re-
filing his application with proper mailing and compliance with the statutory requirements.
