The Court received RDS IL, LLC’s Motion to Vacate Order for Release of Excess
Proceeds of Sale to Thomas Ingoglia and Stephanie J. Ingoglia, filed March 27, 2014. The
Bankruptcy Court has jurisdiction over the debtors. If, as it appears, the debtors failed to
disclose the existence of the excess proceeds to the Trustee, in violation of bankruptcy law, the
Trustee should seek relief in Bankruptcy Court.
IT IS ORDERED denying RDS IL, LLC’s Motion to Vacate Order for Release of Excess

An Application for Release of Excess Proceeds of Sale by Owner having been filed on
October 31, 2013, on the Court’s own motion,
IT IS ORDERED reinstating CV2012-011447 to allow applicant to pursue the release of
excess proceeds. All requirements of A.R.S. § 33-812 must be met.
ALERT: The Arizona Supreme Court Administrative Order 2011-140 directs the Clerk's
Office not to accept paper filings from attorneys in civil cases. Civil cases must still be initiated
on paper; however, subsequent documents must be eFiled through AZTurboCourt unless an
exception defined in the Administrative Order applies.
