12:13 p.m. This is the time set for Oral Argument. Plaintiff, Sonoran Foothills
Community Association, is represented by counsel, Beth Mulcahy. Defendant, Meritage Homes
of Arizona, Inc., is represented by counsel, James E. Holland, Jr.
Court Reporter, Mike Benitez, is present and a record of the proceedings is made by
audio and/or videotape.
Argument is heard regarding Defendant Meritage Homes of Arizona, Inc.’s Motion for
Summary Judgment and Plaintiff’s Cross Motion for Summary Judgment.
IT IS ORDERED counsel shall contact non-parties, Toll Brothers and First American,
regarding their obligation to this litigation, whether they should be added as parties to this
litigation, and/or whether resolution may be reached.
