ORDER OF DISMISSAL
On December 14, 2012, Plaintiff filed a “Motion to Continue on the Inactive Calendar”.
The Court makes note of the following:
•
Plaintiff filed its original Complaint on June 15, 2011.
•
On November 16, 2011, the Court placed this case on the inactive calendar for
dismissal on May 10, 2012.
•
On March 5, 2012, Plaintiff filed a “Motion to Continue on the Inactive
Calendar”. Through this motion, Plaintiff brought to the Court’s attention the fact
that Defendant had filed a bankruptcy petition on September 12, 2011. Given all
of the circumstances, the Court continued the case on the inactive calendar until
September 1, 2012.
•
On August 9, 2012, Plaintiff filed another “Motion to Continue on the Inactive
Calendar”. Through a minute entry dated September 10, 2012, the Court

continued the case on the inactive calendar until January 11, 2013. Through the
same minute entry, the Court warned that this case would be dismissed if certain
action was not taken before that date.
•
The action required by the Court’s minute entry of September 10, 2012, has not
been taken.
Under the circumstances,
IT IS ORDERED denying the “Motion to Continue on the Inactive Calendar” filed by
Plaintiff on December 14, 2012. Further,
IT IS ORDERED dismissing this case off of the inactive calendar.

Pursuant to a motion filed by Plaintiff on August 9, 2012,
IT IS ORDERED continuing this case on the inactive calendar for dismissal on January
11, 2013. This case will be dismissed unless, prior to that date, one of the following occurs: (1)
stay relief is obtained from the bankruptcy court and this court is so advised; (2) the bankruptcy
proceedings are dismissed and this court is so advised; or (3) a motion to continue on the inactive
calendar establishing good cause is filed.
The Court notes that it is quite unlikely that this case will be further continued on the
inactive calendar.
