Nestor-Donohue Deputy SUNSET POINT HOMEOWNERS ASSOCIATION GREGORY A STEIN v. BRADLEY HAGGARD, et al. BRADLEY HAGGARD 25581 W PLEASANT LANE3 BUCKEYE AZ 85326 YARNELL FIRE DEPARTMENT P O BOX 581 YARNELL AZ 85362 BRITTANY HAGGARD NO ADDRESS ON RECORD SECRETARY OF HOUSING AND URBAN DEVELOPMENT NO ADDRESS ON RECORD ORDER ENTERED BY COURT The Court has received Defendant/Judgment Debtor Bradley Haggard’s ex parte motion, “Reimbursement of Filing Fees”. He requests that the Court reimburse his filing fees due to financial hardship and because the hearing was cancelled due to Plaintiff agreeing to lower the percentage rate of the garnishment. This motion is available on the Electronic Court Record (ECR). Upon review and consideration, SUPERIOR COURT OF ARIZONA MARICOPA COUNTY CV 2011-094822 03/22/2018 Docket Code 023 Form V000A Page 2 IT IS ORDERED denying Defendant/Judgment Debtor Bradley Haggard’s request for reimbursement of his filing fee (his one-time initial “answer fee”). If a party wants to come to court to bring a case against someone else or to defend himself in a case brought against him, the Court requires that the party pay a filing fee. If the party cannot afford the filing fee, he is able to apply for a waiver or deferral of court costs before he appears for court hearings or files motions or other documents with the Court. Mr. Haggard did not file for a waiver or deferral of the court costs, but instead paid his filing fee. He will not have to pay the same fee again. In the future, Defendant/Judgment Debtor should also be aware that the Court cannot consider any further ex parte motions or requests. Defendant must endorse Plaintiff’s attorney on any motion or document he files with the Court and he must mail a copy of any motion/document to Plaintiff’s counsel. Otherwise, the motion and documents will be rejected. All parties representing themselves must keep the Court updated with address changes.
