The Court has considered Plaintiff’s Motion for Alternate Service. The Court finds that
service under Ariz.R.Civ.P. 4.1(d) is impracticable but imposes the following additional
requirements to best ensure Defendants are given notice of the Complaint:
IT IS ORDERED that Plaintiff may serve Defendants by:
1.
Mailing a copy of the Summons, Complaint, this Order, and any other paper filed with
the Complaint via the U.S. Postal Service at the Defendants’ last known address as set
forth in the Motion (N. 84th Pl.) by (a) regular mail, and (b) registered mail with delivery
confirmation, and (c) registered mail with signature confirmation; and
2.
Attaching/posting a copy of the Summons, Complaint, this Order, and any other paper
filed with the Complaint to the front door of Defendants’ last known residential dwelling
as set forth in the Motion; and
3.
Mailing a copy of the Summons, Complaint, this Order, and any other paper filed with
the Complaint via the U.S. Postal Service at the Defendants’ place of employment, if
known.
4.
Filing an affidavit attesting to service in accordance with the foregoing paragraphs
within ten days of compliance.

This Court has received Plaintiff Summerfield Unit 5 Homeowners Association’s e-filed
Application for Entry of Default against Defendant Denise Schubel in the above-captioned case
pursuant to Rule 55, Arizona Rules of Civil Procedure. Plaintiff is advised that default
proceedings assigned to Judge Potts are heard by Commissioner Kongable. Pursuant to Supreme
Court Administrative Order No. 2010-117, Plaintiff is further advised that Commissioner
Divisions cannot access e-filed documents at this time. Accordingly, parties are directed to
deliver copies of the necessary documents, including Plaintiff’s e-filed Application/Motion for
Default, to Commissioner Kongable’s Division. Plaintiff is further advised that Commissioner
Kongable will not set any default proceedings or issue any default Judgment until Plaintiff
completes and delivers a default coversheet and packet to Commissioner Kongable’s Division.
Therefore,
IT IS ORDERED that Plaintiff shall deliver copies of its previously filed
Application/Motion for Default and all other default related papers to the Commissioner’s
Division as set forth above.
