RULING MINUTE ENTRY
The Court has considered Plaintiff’s Motion for Alternative Service and Extension of
Time for Service of Defendants Stephen J. Fisher and Tammy Fisher. The Non-Service
Affidavit indicates that there were four attempts to serve Defendants at their home. On one
attempt the baby sitter answered. On the three other attempts, all during morning work hours,
there was no answer at the door. Plaintiff has failed to show that personal service is
impracticable.
IT IS ORDERED denying Plaintiff’s Motion for Alternative Service.
IT IS FURTHER ORDERED granting Plaintiff’s Motion for Extension of Time for
Service.
IT IS FURTHER ORDERED Plaintiff shall have until December 6, 2009 to accomplish
service.
