against the debtor from the claim against the other parties to the action, if any; or it has
demonstrated a reasonable basis for continuance of the case on the inactive calendar.

Any party may ask the Court to schedule an informal status conference before the 180-
day period expires to inform the Court what action, if any, is undertaken in the Bankruptcy Court
that would permit this case to proceed.
IT IS ORDERED that as to the remaining Defendants, the provisions of Rule 38.1,
A.R.C.P. shall continue to apply.
IT IS FURTHER ORDERED affirming the Order to Vacate Judgment signed by the
Court on February 18, 2010 and filed (entered) by the Clerk on February 22, 2010.

RULING MINUTE ENTRY
The court has received and reviewed Plaintiff’s Motion for Summary Judgment and
Plaintiff’s Motion for Summary Disposition (of Plaintiff’s Motion for Summary Judgment).
Defendants have failed to respond, which is deemed a consent to the Motions, pursuant to Rule
7.1(b), Ariz.R.Civ.P. The court finds the Motions demonstrate that Plaintiff is entitled to the
requested relief. Therefore, based on the reasons set forth in Plaintiff’s Motions,
IT IS ORDERED granting Plaintiff’s Motion for Summary Disposition
IT IS FURTHER ORDERED granting Plaintiff’s Motion for Summary Judgment.
IT IS FURTHER ORDERED directing Plaintiff’s counsel to lodge a form of Order for
the court’s consideration and signature, along with an application and affidavit of attorney’s fees
and costs on or before October 5, 2009.
