RULING MINUTE ENTRY
The court has received and reviewed Plaintiff’s Motion for Summary Judgment.
Defendants have failed to respond, which is deemed a consent to the Motion, pursuant to Rule
7.1(b), Ariz.R.Civ.P. The court finds the Motion demonstrates that Plaintiff is entitled to the
requested relief and also pursuant to A.R.S. § 12-341.01 and contract, Plaintiff is entitled to an
award of attorney’s fees. Therefore, based on the reasons set forth in Plaintiff’s Motion,
IT IS ORDERED granting Plaintiff’s Motion.
IT IS FURTHER ORDERED directing Plaintiff’s counsel to lodge a form of Judgment
for the court’s consideration and signature, along with an affidavit of attorney’s fees and costs on
or before December 25, 2009.
