MINUTE ENTRY
The Court has received the Plaintiff’s Motion for Summary Judgment and the responsive
filing entitled Reply to Motion to Continue Disclosure and Request for Summary Judgment.
Denial by Defendant that he did not receive Exhibit B to the motion is insufficient to
preserve a genuine issue as to a material fact. Exhibit C to the Motion shows various prior
warnings, late notices, intents to lien and a returned check for insufficient funds.
IT IS ORDERED granting Summary Judgment in favor of Plaintiff which renders moot
the Motion to Continue Disclosure Requirements Under Rule 26(b)(1).
Plaintiff shall submit a form of judgment consistent with the ruling.
