Michael K. Jeanes, Clerk of Court *** Electronically Filed *** 03/31/2008 8:00 AM SUPERIOR COURT OF ARIZONA MARICOPA COUNTY CV 2007-092813 03/27/2008 Docket Code 019 Form V000A Page 1 CLERK OF THE COURT HONORABLE JOSEPH KREAMER T. Soto Deputy REGENCY HOUSE ASSOCIATION CHARLES E MAXWELL v. DAVID JOLLIFFE, et al. DAVID JOLLIFFE NO ADDRESS ON RECORD WELLS FARGO BANK NATIONAL ASSOCIATION NO ADDRESS ON RECORD MINUTE ENTRY The Court has received and reviewed Plaintiff’s Motion for Alternative Method of Service. The Motion states that Defendant Jolliffe is evading service and seeks an order permitting Plaintiff to serve him by leaving a copy at his last known address and by sending him another copy via mail to the same address. However, the “Certificate of Due Diligence” provided with the Motion simply states that his last known address is “vacant” and his PO Box in New Mexico also came back as “unknown.” This does not provide the Court with a basis to find that Defendant is “evading service.” Further, Plaintiff is essentially asking the Court to allow for service where the Plaintiff will be delivering and mailing the Summons and Complaint to a vacant address. The Motion is therefore DENIED.
