10:33 a.m. This is the time set for Hearing re: the Applications for Release of Excess
Proceeds, filed by GMAC, LLC, Del Lago Homeowners’ Association, and JPMorgan Chase
Bank, NA. Applicant Del Lago Homeowners’ Association is represented by counsel, Kristen L.
Rosenberg (appearing for Beth Mulcahy). Applicant JPMorgan Chase Bank, NA is represented
by counsel, Lisa Sue Kass (appearing for Larry O. Folks). No other party is present or
represented.
A record of the proceedings is made by CD (FTR) in lieu of a court reporter.
Counsel for JPMorgan Chase advises the Court that she does not believe GMAC will be
appearing today as it appears there will be no funds available to GMAC after disbursement to
Del Lago and JPMorgan, both of whom have priority over GMAC’s claim.
Court and counsel briefly discuss the pending Applications for Release of Excess
Proceeds.
Based upon the foregoing,
IT IS ORDERED finding that JPMorgan Chase is entitled to excess proceeds in the sum
of $277,357.33, less the $30.00 fee to the Treasurer’s Office, in accordance with the formal
written Order Directing the Distribution and Release of Excess Sale Proceeds Pursuant to A.R.S.
33-812(I), signed by the Court this date in open court and entered (filed) by the clerk on
February 5, 2007.
