The court has received proposed orders from applicant Roseview Homeowners
Association (“Applicant”). Applicant is requesting $1129.75 in principal from the excess
proceeds, $567 in attorneys’ fees, and $181 in costs. The court does not have an affidavit of
attorneys’ fees and costs in order to review the reasonableness o f the pending requests.
Moreover, in light of the opinion in Hanley V. Pearson, 204 Ariz. 147, 61 P.3d 29 (App. 2003),
the court questions whether it has the authority to award the requested fees and costs. If
Applicant (or any party) wishes to be heard on these issues, an appropriate memorandum may be
filed by April 1. If no such filing is received, the court will likely grant the application only to
the extent of the principal amount.
