9:45 a.m. This is the time set for an order to show cause hearing. Plaintiff is represented
by counsel Jeff Corben. Defendants are neither present nor represented by counsel.
Court reporter, Michele Sink, is present.
A copy of the Affidavit of Service is handed to the Court and discussed.
After review of the copy of the Affidavit of Service,
THE COURT DOES HEREIN FIND that the Wades were served pursuant to the Rules
of Civil Procedure and this is an effective service based on the comments of the process server.
THE COURT FURTHER FINDS that it is approximately 20 minutes after the time the
hearing was set to proceed and the Defendants are not physically present. The Court will
proceed in this matter by default as to Defendants Wade.

THE COURT HEREIN FINDS, after having heard the testimony of the witness,
that Defendants Wade are in violation of the CCRs; accordingly,
IT IS ORDERED granting the Permanent Injunction all in accordance with the formal
written order signed by the Court and entered (filed) by the clerk on June 12, 2003.
Discussion is held regarding counsel’s request for attorney fees.
For the reasons set forth on the record,
IT IS HEREIN ORDERED awarding Plaintiff attorney fees.
IT IS FURTHER ORDERED that Plaintiff shall within 20 days to file an Affidavit of
Attorney Fees and Costs.
IT IS FURTHER ORDERED that Defendants shall have 15 days thereafter to file a
response and Plaintiff shall have 5 days thereafter to file a reply. The matter will then be deemed
submitted for this Court’s determination.

As there currently exists a stay of all proceedings pending an appeal, the Court will take
no action on Plaintiff’s Application for Attorneys’ Fees and Costs.
IT IS ORDERED that Plaintiff shall provide notice to the Court once the appeal process
has been completed so that the Court may address this motion in light of the Appellate Court’s
determination.

authority.
The permanent injunction shall remain in effect until further Order of the Court. The
