The Court has considered counsel for the defendant Sterrett’s Application for Attorney’s
Fees. Judge Campbell awarded defendants Sterrett and Grangers attorney’s fees when he
dismissed the Plaintiff’s Complaint at an Order to Show Cause hearing held on January 16, 2007.
The Court has carefully reviewed the Affidavit of David Bodney. Including Exhibit A,
attached which is an itemized Statement of Attorney’s Fees and Costs. The Court has also
carefully reviewed the electronic Court file in this case. Comparing the work done by counsel
for defendants Sterrett, including motions, joinder, appearance at one 10 minute hearing, notices
and other compared to work done by counsel for Defendant’s Granger, as reflected in counsels’
Affidavits and statements and in the documents on file, the Court finds that counsel for
Defendant Sterretts did, at most, approximately triple the amount of work done by counsel for
defendants Granger. The Court has also considered the hourly billing rates for the attorneys
involved.

THE COURT FINDS that $9,000.00 is the reasonable and necessary amount of
attorney’s fees awardable to defendants Sterrett, and, therefore, awards same all in accordance
with formal written Judgments (2) signed by the Court on February 28, 2007 and entered (filed)
by the Clerk on March 1, 2007.
