The Court has read and considered the plaintiff’s Motion for Alternative Service as to
Guncha Gul.

Rule 4.1(k)(1) requires the plaintiff to show that the means of service provided in Rule
4.1(c) through 4.1(j) are impracticable. The Court finds that four attempts to serve the defendant
at the Paradise Village Parkway address are not enough to demonstrate that Rule 4.1(d) service is
impracticable, given that the process server’s observations indicate that someone is living at that
address. The Court is also concerned that service to that address may not qualify as “a reasonable
effort to provide the person being served with actual notice of the action’s commencement,” as
required by Rule 4.1(k)(2). The neighbor said the occupant “recently moved in,” and the packages

at the door were not addressed to the defendant, both of which suggest that the defendant may not
be the current occupant.

IT IS THEREFORE ORDERED the Court takes no action on the Motion for Alternative
Service at this time. The plaintiff may supplement the motion at any time before the expiration of
the deadline for service of process as extended by the orders of this Court. If no timely supplement
is received, the motion will be denied.
