On December 21, 2012, Plaintiff filed a “Renewed Motion to Continue on the Inactive
Calendar”. The Court makes note of the following:
•
Plaintiff filed its Complaint on June 27, 2011. This case is now almost 19 months
old.
•
Defendants long ago filed a Chapter 13 Bankruptcy petition.
•
In the context of Bankruptcy Court proceedings, it has been agreed that Plaintiff
would be treated as a secured creditor and would be paid its full claim through the
Chapter 13 plan.

Through a minute entry issued on August 23, 2012, the Court continued this case
on the inactive calendar for dismissal on December 24, 2012. At that time, the
Court warned that the case would be dismissed if certain action was not taken
before that date.
•
The above referred to Motion is Plaintiff’s third Motion to Continue on the
Inactive Calendar.
•
Plaintiff attached a recent report of the Bankruptcy Trustee to the pending motion.
At the time of that report, Defendants were essentially in compliance with their
payment requirements, being only five dollars delinquent.
THE COURT FINDS that good cause for further continuance on the inactive calendar
has not been established. Under the circumstances,
IT IS ORDERED denying Plaintiff’s “Renewed Motion to Continue on the Inactive
Calendar”. Further,
IT IS ORDERED dismissing this case off of the inactive calendar.
