This Court has received Plaintiff’s e-filed Application for Entry of Default and Affidavit
on Default and Entry of Default against defendant(s) Kurt A. and Kathleen A. Luther, Carmel
Financial Corporation, Inc., and Midland Funding, LLC in the above-captioned case
pursuant to Rule 55, Arizona Rules of Civil Procedure. Plaintiff is advised that default
proceedings assigned to Judge Aceto are heard by Commissioner Benny. Pursuant to Supreme
Court Administrative Order No. 2010-117, Plaintiff is further advised that Commissioner
Divisions cannot access e-filed documents at this time. Accordingly, parties are directed to
deliver copies of the necessary documents, including Plaintiff’s e-filed Application for Entry of
Default and Affidavit on Default and Entry of Default, to Commissioner Benny’s Division.
Plaintiff is further advised that Commissioner Benny will not set any default proceedings or issue

any default Judgment until Plaintiff completes and delivers a default coversheet and packet to

papers to the Commissioner’s Division as set forth above.

packets are not permitted to be e-filed. Accordingly, parties are directed to hand-deliver a
default coversheet and copies of the necessary filed documents to the Commissioner’s division

IT IS FURTHER ORDERED, no further action will be taken by the assigned
Commissioner until the necessary filed documents and coversheet are delivered to the division.
