JOSEPH M GULLION MINUTE ENTRY The Court is in receipt of Plaintiff Grayhawk Community Association’s Motion for Alternative Form of Service and proposed form of Order. IT IS ORDERED denying Plaintiff’s Motion. Plaintiff has not demonstrated that service was impracticable. There is no evidence that Defendant was present when the process server attempted service. In addition, alternative service of posting and mailing is no better service than service on a person of suitable age and discretion residing with Defendant at the place of service. There were several opportunities for such service. In any event, absent personal service a civil arrest warrant cannot issue for failure to appear. See Rule 64.1 (b), Arizona Rules of Civil Procedure.
