North Canyon Ranch Owners Association filed a Petition for Release of Surplus Funds
from Trustee’s Sale. Sean Scalley objected. The HOA obtained a Judgment that included
attorney’s fees in the amount of $3,569.28. The HOA's Petition provides no supporting
documentation to support a claim for an additional $2,587 in reasonable attorney's fees.
IT IS ORDERED North Canyon's Petition is granted as to $3,569.28. The Court has
signed the form of order submitted with the appropriate modification. Mr. Scalley may submit a
form of order for the remainder of the excess proceeds.
ALERT: The Arizona Supreme Court Administrative Order 2011-140 directs the Clerk's
Office not to accept paper filings from attorneys in civil cases. Civil cases must still be initiated
on paper; however, subsequent documents must be eFiled through AZTurboCourt unless an
exception defined in the Administrative Order applies.

Claimant North Canyon Ranch Owners Association filed an Objection to the Form of
Judgment Submitted by Sean Scalley and Motion to Vacate January 21, 2014 Minute Entry.
There is no basis to vacate the previous ruling, which was based on the lack of documentary
support for Canyon’s request for additional attorneys’ fees. The Court mistakenly signed the
form of order submitted by North Canyon without making the modifications stated in the minute
entry.
IT IS ORDERED North Canyon’s Objection to the Form of Judgment and Motion to
Vacate January 21, 2014 Minute Entry is denied.
IT IS FURTHER ORDERED the order signed on January 21, 2014 and filed on
January 24, 2014 is amended, nunc pro tunc, to strike the amount of $5806.33.
IT IS FURTHER ORDERED that the Maricopa County Treasurer shall release the
remaining excess proceeds in the amount of $3569.28 to Applicant/Claimant, North Canyon
Ranch Owners Association, upon presentation of this order, less a $30.00 processing fee payable
