The Court makes the following orders:
1. Evidentiary hearing re: Plaintiff’s request for preliminary injunction is set for
November 20, 2006 at 10:00 a.m. (1 hour) in this division. Each side will
have 30 minutes in which to present their case.
2. Either party who wishes to may present evidence at the hearing by way of
declaration or affidavit, as long as the declarant or affiant is available by
phone or in person for cross examination.

3. Not later than 14 calendar days before the hearing both parties are to exchange
with the other side all exhibits and all declarations or affidavits they intend to
use at the hearing, as well as a list of all witnesses they intend to call for live
testimony, describing those witnesses with sufficient detail to comply with the
disclosure rules.
4. A limited and reasonable amount of discovery may be made before the
hearing. If counsel cannot agree on what a limited and reasonable amount of
discovery is, they are to telephone the Court for further direction.
5. A mandatory meet and confer between counsel, the Defendant homeowners
and a responsible or authorized representative(s) of the HOA is to take place
not later than November 13, 2006.
6. Mr. Richardson is to file a report with the Court not later than November 15,
2006 regarding the results of the meet and confer.
The Court encourages settlement of this matter.
