The Court has considered Plaintiff’s Motion for Extension of Time to Serve John
Brancella Only. Plaintiff seeks additional time to finalize settlement negotiations and allow time
for payments to be made. A settlement agreement is an independent contract separate and apart
from the underlying action. The Court will not continue a matter on the dismissal calendar
pending satisfaction of the terms of a settlement agreement. Plaintiff has obviously located this
