The Court has considered the Plaintiff’s Motion for Summary Judgment and the
Defendant’s Response.

The Court finds that there exists genuine issues of material fact so that summary
judgment is inappropriate. The Court further finds that Plaintiff is not entitled to summary
judgment as a matter of law. Accordingly,

IT IS ORDERED denying Plaintiff’s Motion for Summary Judgment.
