The Court is in receipt of the Stipulation for Appointment of Receiver between Plaintiff
and F6 Homes, LLC and the Objection to Proposed Receivership Order filed by Defendant
Tartesso and discussion is held regarding same.
Pursuant to counsel’s request, a brief recess will be taken to allow the parties to discuss
the receivership order.
2:00 p.m. Court stands at recess.
2:16 p.m. Court reconvenes with respective counsel present.
A record of the proceedings is made by audio and/or videotape in lieu of a court reporter.
Discussion continues regarding modifying the receivership order and the Court makes the
changes to the order as stated on the record.
IT IS ORDERED setting a hearing on July 22, 2011 at 11:30 a.m. for the purpose of
resolving any further issues regarding a final order. If counsel are able to stipulate to a final
order, a request to vacate the hearing may be submitted. All parties noticed on the original
stipulated order must be given notice of the amended final order.
IT IS FURTHER ORDERED setting a bond in the amount of $10,000.00.
Pursuant to discussion, counsel will make the last modifications to the order, whereupon
the Court will sign the order.

Discussion is held regarding the revised red-lined Order Authorizing Receiver to Sell
Property of Receivership Estate submitted to the Court this date.

Argument is presented on the objections to the Receiver’s Motion filed by The Town of

IT IS ORDERED overruling Blandford Home LLC’s objection to the Receiver’s Motion.
Discussion is held on The Town of Gilbert’s request for additional time to review the
revised order.
Counsel for the Receiver is instructed to submit a new order for the Court’s approval that
includes the approved changes for the non-Gilbert properties.
Counsel for The Town of Gilbert is instructed to submit the order pertaining to the
Gilbert properties with any proposed changes by December 2, 2011. To the extent changes are
required other than what is in the current order, The Town of Gilbert is responsible for
providing the necessary notice and obtaining either signatures or objections from all other parties
who have already agreed to the revised order. Counsel shall make the effort to contact other
counsel personally in order to expedite the review of any changes.
IT IS FURTHER ORDERED setting a hearing on December 5, 2011 at 3:00 p.m. for the
purpose of resolving any issues regarding proposed language in the order for the properties in
Gilbert. If counsel reach an agreement as to the order, they may request to vacate the hearing.
Counsel are requested to make sure all interested parties receive notice of the hearing.

Fargo Bank is represented by counsel, Benjamin Reeves, appearing telephonically. The
Receiver is represented by counsel, Sean McElenney appearing telephonically. Intervenor,
Town of Gilbert is represented by counsel, Larry Udall who is present. The Maricopa County
Treasurer’s Office is represented by counsel, Lori Lewis, appearing telephonically.

Mr. McElenney reports that the parties have reached an agreement and a final order was
created and sent to the interested parties but the Plaintiff and Town of Gilbert have made
additional changes to that order and the parties still have to review and approve those changes.

IT IS ORDERED resetting today’s hearing to December 13, 2011 at 10:00 a.m.
Counsel shall make their best effort to work out language that’s acceptable to the parties having
the disagreements as early as possible. If they are unable to reach an agreement, they should
submit alternate proposals indicating what the area of disagreement is and indicating that the
Court intends to resolve the issue by either adopting one of the proposals or some modification
thereof. Notice should be given to the parties of each side’s preferred language and if any party
has an interest in the disputed area, they can attend the hearing to voice their concerns and the
Court will decide what language will be used on that day.
Counsel for the Town of Gilbert agrees to provide notice of the hearing to the parties.
