JUDGMENT OF DISMISSAL WITHOUT PREJUDICE
By minute entry dated February 4, 2011, The Honorable Robert Budoff directed the
parties to submit a Stipulation for Dismissal pursuant to their settlement by March 25, 2011.
Judge Budoff advised the parties that in the event they did not file such a stipulation, the case
would be dismissed. Although Plaintiff attempted to voluntarily dismiss the case on May 6,
2011 by filing a Notice of Dismissal, that Notice was not effective because (1) Defendant
Bridgewood Nine 30 Property Owners Association, Inc. filed an Answer to the Complaint prior
to the filing of the Notice of Dismissal; and (2) the Notice references dismissal by an individual
who is not a party to this case, i.e., “Plaintiff Jacob Forrest.”
This case having been continued on the Inactive Calendar for dismissal on March 25,
2011 unless specified action was taken before that date, and the action having not been taken,
IT IS ORDERED dismissing this case without prejudice.
IT IS FURTHER ORDERED signing this minute entry as the formal order of this
Court.

ALERT: Effective September 1, 2011, the Arizona Supreme Court Administrative Order
2011-87 directs the Clerk's Office not to accept paper filings from attorneys in civil cases. Civil
cases must still be initiated on paper; however, subsequent documents must be eFiled through
AZTurboCourt unless an exception defined in the Administrative Order applies.
