IT IS FURTHER ORDERED that all documents necessary to support the entry of a
default judgment must be either e-filed or filed in paper form.
Pursuant to the Maricopa County eFiling Guidelines, section 2.09, attorneys shall
electronically file all the documents required to request a default judgment, such as the Application
for Entry of Default, Motion for Entry of Default Judgment, Sum Certain Affidavit, Application
for Attorneys’ Fees when appropriate, and Statement of Costs.
Self-represented litigants are exempt from any mandatory eFiling requirements but may
eFile if they prefer.
Attorneys and Self-Represented Litigants must submit a default judgment packet required
by the Court, including the documents identified on the default judgment packet coversheet in
paper to the assigned commissioner’s division.
A commissioner will not act upon a Motion for Entry of Default Judgment until the

If the paper packet is not received by the above-named Commissioner division by May 12,
2026, the matter will be dismissed without prejudice for lack of prosecution as to the defaulted

The Court has reviewed both motions and the response briefs. The Court finds that oral
argument is not necessary to resolve the motions.
Motion to Strike
Plaintiff moves to strike Maria Papas’ answer that was filed on 2-12-2026. Plaintiff
argues that the Answer does not meet the procedural requirements of Rule 8(c) because it does
not admit or deny each of the allegations in the First Amended Complaint.
Ms. Papas has filed two answers to the First Amended Complaint. The first one was filed
on October 15, 2025. In that answer she issued a general denial to the allegation sin the
Complaint.
Although Ms. Papas’ pleadings have been somewhat confusing, the Court does not find a
basis to strike her Answer(s). Plaintiff’s motion to strike is denied.
Motion for Partial Dismissal
Ms. Papas’ motion for partial dismissal seeks to dismiss “the claims asserted against her
in her individual capacity.” The motion, however, is inconsistent and contradictory. In the same
motion, she seeks to assert counterclaims that were not pled in her Answer. She also objects to
default proceedings that do not apply to her and asks to “remain as a named Defendant and
interested party.”
Plaintiff’s response to the motion notes the above inconsistencies. Plaintiff also states
that Ms. Papas was only named in the First Amended Complaint because she claims to be an heir
to The Estate of Nick Lentzos. Ms. Papas’ motion attaches, as Exhibit A, Letters of Authority for
Personal Representative. The Letters indicate Vasiliki Pappas is the personal representative of
The Estate of Nick Lentzos. Plaintiff asks that Ms. Papas be dismissed from the case entirely.
The Court agrees with Plaintiff that there is no basis for Ms. Papas to remain in the case.
Accordingly,
IT IS ORDERED:
1. Denying Plaintiff’s Motion to strike Maria Papas’ Answer.
2. Dismissing Maria Papas from the case entirely.
IT IS FURTHER ORDERED directing Clerk of Court, Docket personnel, to remove the
dismissed Maria Papas only, referenced above from the caption of this case.

On April 7, 2026, Plaintiff filed a Response to Joinder by Personal Representative. In its
Response, Plaintiff requests that the Court set an evidentiary hearing to clarify the parties’
interest in this matter.
After Plaintiff’s Response, the Court entered an Order dismissing Maria Papas from the
case. However, the Court finds that a status conference is warranted to verify Vasiliki Pappas’
position as the personal representative of The Estate of Nick Lentzos, and to address whether this
case should be consolidated with CV2025-033417. Accordingly,

Discussion is held regarding Ms. Pappas’ relation to Defendant Nick Lentzos, and his
estate. She informs the Court that she is his sister.
Discussion is held regarding Ms. Pappas’ representation of Mr. Lentzos’ estate.
The Court notes that when Ms. Pappas appeared in this action, she asked to be substituted
in as the party for Nick Lentzos and his estate. She has provided documentation that she is the
personal representative. Until related issues are resolved more conclusively, the Court finds that
it is appropriate to grant Ms. Pappas’ request. Therefore,
IT IS ORDERED directing the Clerk of the Superior Court – Docket personnel to
substitute Vasiliki Pappas as the Defendant party in place of both Nick Lentzos, and also the
Estate of Nick L. Lentzos.
Discussion is held regarding consolidation between this matter and CV2025-033417.
Plaintiff objects to consolidation because the two cases involve different properties. Accordingly,
the Court will not consolidate the cases at this time.
Discussion is held regarding the lack of an answer by Ms. Pappas in both cases.
For reasons stated on the record,
IT IS ORDERED that Defendant Vasiliki Pappas shall file an answer to the Complaint
by no later than May 14, 2026. Defendant is advised to make sure that she additionally sends a
copy of any pleading that she intends to file with the Court to Plaintiff’s counsel.

IT IS FURTHER ORDERED that all documents necessary to support the entry of a
default judgment must be either e-filed or filed in paper form.
Pursuant to the Maricopa County eFiling Guidelines, section 2.09, attorneys shall
electronically file all the documents required to request a default judgment, such as the Application
for Entry of Default, Motion for Entry of Default Judgment, Sum Certain Affidavit, Application
for Attorneys’ Fees when appropriate, and Statement of Costs.
Self-represented litigants are exempt from any mandatory eFiling requirements but may
eFile if they prefer.
Attorneys and Self-Represented Litigants must submit a default judgment packet required
by the Court, including the documents identified on the default judgment packet coversheet in
paper to the assigned commissioner’s division.
A commissioner will not act upon a Motion for Entry of Default Judgment until the
default judgment packet with all the required documents has been received by the division
in paper form.
If the paper packet is not received by the above-named Commissioner division by March
2, 2026, the matter will be dismissed without prejudice for lack of prosecution as to the defaulted
party.
