The Court received and reviewed the Application for Entry of Judgment on Writ of
Garnishment. Garnishee’s answer indicates a third-party may have an interest in the funds
garnished. Accordingly, until that third-party is served with the order joining the third-party, the
third-party has had twenty days to request a hearing after service, and no request for hearing has
been filed, the Court will not enter the requested Judgment Against Garnishee. Accordingly,
IT IS ORDERED denying the Application for Entry of Judgment on Writ of
Garnishment without prejudice.

The Court received and reviewed the Application for Entry of Judgment on Writ of
Garnishment. The record reflects that (1) non-party Sandra Fialkin was joined as a third-party,
but not provided information on how, where, or when to object or request a hearing (see Order
Joining Third Party entered August 7, 2018), and (2) the person served with the Order Joining
Third Party was Jodi Fialkin, not Sandra Fialkin (see Certificate of Service by a Private Process
Server). For these reasons, it is not clear from the record that non-party Sandra Fialkin has been
properly served with the Order Joining Third Party, or if she had, that she was made aware of her
right to object and/or request a hearing the deadline for any such objection/request. Accordingly,
IT IS ORDERED denying the Application for Entry of Judgment on Writ of
Garnishment without prejudice.
