Garnishee filed its Answer on December 28, 2015. A.R.S. § 12-1598.10(E) states that the garnished earnings or property “shall be released to the judgment debtor” and the Garnishee “shall be discharged” if an order of continuing lien is not entered within 45 days after the Garnishee’s Answer is filed. As the Garnishee’s Answer was filed on December 28, 2015, the 45 day period ran out before the order was entered. IT IS ORDERED denying the Application for Order of Continuing Lien. IT IS FURTHER ORDERED discharging Garnishee in accordance with A.R.S. § 12- 1598.10(E).
