The Court received the Stipulation to Entry of Permanent Injunction filed July 16, 2021.
The proposed form of injunction includes Arizona Rule of Civil Procedure 54(b) language. That
rule seems inapplicable because this matter has only one Defendant. It would be inappropriate for
the Court to enter an order—whether captioned “judgment” or “permanent injunction”—with Rule
54(b) language here. It is not clear if Plaintiff intends the permanent injunction to be the final
judgment. If so, Plaintiff should clarify if it is forgoing a possible award of fees and costs.
Accordingly,
IT IS ORDERED that Plaintiff must file a statement clarifying the intended purpose of
the stipulated permanent injunction vis-à-vis a final judgment. This statement is due within five
days of the Clerk filing this order.

The Court received the Stipulation to Entry of Permanent Injunction (filed
07/16/2021). The Court asked the parties to clarify why they included Arizona Rule of Civil
Procedure 54(b) language in the proposed form of order. [Min. Entry (filed
07/21/2021).] Inexplicably, the parties did not respond to the Court’s inquiry. Thus, the Court
will enter the injunction without any Rule 54 language. The Court also will place this matter on
the dismissal calendar through September 15, 2021.
IT IS SO ORDERED.
