The Court has received an application for release of excess proceeds. From a review of
the file, it is unclear to the Court whether there are any other potential claimants with higher
priority. If no other potential claimants file an application, Applicant may file a motion to vacate
the hearing and release the proceeds after the 180 day period has run.
IT IS ORDERED setting this matter for a hearing in accordance with A.R.S. § 33-812(J)
on August 22, 2016, at 11:30 a.m., in this division:
Maricopa County Superior Court

IT IS FURTHER ORDERED that each applicant shall have a proposed form of order for
release of excess proceeds available for review at the time of the hearing.
If an applicant does not have a proposed form of order available for review at the time of
the hearing, that applicant will likely have to have their portion of the hearing reset to a later
date.
Each applicant should confirm prior to the hearing that they have fully complied with the
requirements set forth in A.R.S. § 33-812, particularly subpart (G). If an applicant has not
complied with the statutory requirements prior to the hearing, their application will likely be
denied and they will need to start the process over.

discouraged.
