The Court having reviewed the Application by Plaintiff for an Award of Attorney’s Fees
Against Defendant Washington Mutual Bank and Statement of Costs Against Washington
Mutual Bank, Defendant Washington Mutual Bank’s Objection, Plaintiff’s Reply, and good
cause appearing,
IT IS ORDERED denying the Application by Plaintiff for an Award of Attorney’s Fees
Against Defendant Washington Mutual Bank but awarding Plaintiff its taxable costs in the
amount of $1,459.55 all in accordance with the formal written Judgment signed by the Court on
February 8, 2008 and entered (filed) by the Clerk on February 8, 2008. This Court in denying
Plaintiff’s application for attorney’s fees finds that while Plaintiff’s claims for relief in part,
arguably sound in contract, there is no privity of contract between Plaintiff and Defendant
Washington Mutual, Plaintiff is in first lien position strictly by good fortune, Washington

Mutual’s defenses were pled in good faith, both Plaintiff and Washington Mutual were victims

IT IS ORDERED modifying the Court’s ruling of June 24, 2008 as follows:
The Court requires that a $1,400.00 cash or surety supersedeas bond be posted for the
purposes of staying the execution of the judgment entered in favor of A to Z Printing and against
WAMU.
Because of the Court’s concerns with respect to the non-occupancy and potential waste of
the subject property, and the Court having determined that A to Z Printing’s lien interest is
superior to that of WAMU, and the fact that A to Z Printing was aware of the prior indebtedness,
IT IS ORDERED that WAMU will be required to post a supersedeas bond to stay the
foreclosure proceedings on the subject property in the amount of $200,000.00 in either cash or
surety.
2:05 p.m. Matter concludes.
IT IS FURTHER ORDERED signing this minute entry as a formal order of this Court
pursuant to Rule 81, Arizona Rules of Family Law Procedure.

telephone call. Counsel are advised that all parties shall use a landline and that no party will be
allowed to appear by cell phone.
IT IS FURTHER ORDERED that by February 5, 2008, the parties shall submit to the
Court a Joint Pretrial Memorandum setting forth the following:
1. The parties proposed schedule for additional discovery including
depositions and all other discovery pursuant to the rules of procedure or
as agreed upon by the parties. NOTE: The date for disclosure of non-
expert witnesses must be at least forty-five days before the completion of
discovery.

2. The parties' proposed schedule for disclosure of expert witnesses and
designation pursuant to Rule 26(b)(4). NOTE: The disclosure should
be within ninety days of the scheduling conference except upon a
showing of good cause.
3. The parties' proposed schedule for any agreed upon amendments to the
pleadings and any requested amendments to the pleadings.
4. The parties' proposed date for a settlement conference.
5. The parties' proposed date for trial. NOTE: The parties should come to
the scheduling conference with the trial calendars of the attorneys
responsible for trial.
If there are any discovery disputes, they must be filed with the Court by motion at least ten
days prior to the scheduling conference. A response must be filed not less than three days prior to
the conference. No reply will be filed. The Court will assess any appropriate sanction if the Court
finds that any party or attorney engaged in unreasonable, groundless, abusive or obstructionist
discovery.
