Should an official transcript be required, you may request that the court prepare it. The
party ordering the transcript must pay for it. To request a transcript call 602-506-7100 and

appeal, and your name, address and telephone number. With this new technology, a court
reporter is likely not required and the parties are encouraged to experience the court's video
recording system before requesting a court reporter. If a court reporter is required, the court must
receive a written request at least 3 court days before the commencement of the proceeding.
Failure to timely request a court reporter will be deemed consent to proceed without a court
reporter.
IF ANY ISSUES IN THE MOTION RELATE TO DISCOVERY PROBLEMS,

Counsel are advised that if the answering memorandum is not timely filed in accordance
with the Arizona Rules Of Civil Procedure, oral argument may be vacated and the motion will be

For the reasons stated, the Court finds that Ms. Carras does have standing to assert
privilege related to the requested e-mails. Ms. Foster is directed to go through the list of e-mails
provided by opposing counsel and prepare a log indicating which e-mails can be provided and
which e-mails are considered privileged and whether an in camera review of those e-mails is
being requested. Counsel has agreed to provide the log to the Court by August 10, 2015.

On April 16, 2015, this Court granted the parties’ Joint Motion to Release Interplead
Funds, and pursuant to the Notice of Settlement, ordered that the matter would be placed on the
dismissal calendar for dismissal within 120 days.
In the meantime, non-party Joanne Carras filed a Motion for Protective Order, and the
Court directed counsel for Ms. Carras to provide a log to the Court regarding the disputed
information by August 10, 2015. On August 25, 2015, counsel filed a privilege log, and
indicated that the parties are not requesting an in camera review at this time because they are
attempting to resolve the dispute.
Therefore, on the Court’s own motion,
IT IS ORDERED continuing this matter on the dismissal calendar for ninety (90) days.

Non-party Joanne Carras filed a Motion for Protective Order, and the Court directed
counsel for Ms. Carras to provide a log to the Court regarding the disputed information by
August 10, 2015. On August 25, 2015, counsel filed a privilege log, and indicated that the
parties were not requesting an in camera review because they were attempting to resolve the
dispute.
The Court has now received Ms. Carras’ Notice of Withdrawal of her Motion for
Protective Order, filed September 23, 2015. Ms. Carras indicates that the parties have settled
their discovery disputes.
