On December 21, 2016, Appellant, Dynamite Mountain Ranch Homeowners
Association, filed a Notice of Appeal for Judicial Review of Administrative Decision against
Appellee, Arizona Department of Real Estate, and Appellee, Lotay Yang; and Sun Strand, LLC,
pursuant to Arizona Revised Statutes Annotated (A.R.S.) §§ 12–901 to 12–914.
IT IS ORDERED that Appellant serve both Appellees with a copy of the Notice of
Appeal for Judicial Review of Administrative Decision in the manner provided by A.R.S. § 12–
906.1
IT IS FURTHER ORDERED that Appellant shall file proof of service with the Clerk of
the Superior Court of Maricopa County as required by Rules 4(g) and 4(i) of the Arizona Rules
of Civil Procedure.

IT IS FURTHER ORDERED that a Notice of Appearance from all Appellees shall be
due 20 days from the date of service of Appellant’s appeal.
Appellant is advised that, if Appellant fails to effectuate service or to order the record or
the transcripts as ordered herein, this Court may dismiss these proceedings.
IT IS FURTHER ORDERED that the administrative agency or board shall transmit its

The information provided by Appellant establishes that as to Lotay Yang, service has
been accomplished.
Therefore,
IT IS ORDERED granting the request to find that Lotay Yang has been served.
The Court notes that Appellant requested an order that Appellees “file a responsive
pleading” pursuant to the Rules of Civil Procedure. No answer or other responsive pleading is
required in this administrative appeal. Instead, as this Court’s Minute Entry of January 5, 2017
sets out, once all the appropriate actions have been taken (including Appellant’s filing of a
Notice of Action and Appellant’s making arrangements to pay for preparation of pertinent
portions of the record, as well as transmittal of that record), the parties will be required to file
their briefs pursuant to Rule 6 of the Rules of Procedure for Judicial Review of Administrative
Decisions.
Upon review of the docket, the Court noted that the Association filed a Motion for Stay
and a Motion for Evidentiary Hearing. This Court was not provided with copies of either Motion.
Because this Court does not participate in e-filing, courtesy copies of all motions must be
provided to the Court. Failure to do so may result in the Court being unaware that a Motion has
been filed, and thus not ruling on the motion in a timely fashion.
Because the Association provided no basis to conduct an evidentiary hearing,
IT IS ORDERED denying the Motion for Evidentiary Hearing.
As to the Motion for Stay,
IT IS ORDERED granting a provisional stay, pending an opportunity for Mr. Yang to
respond to the Motion. If Mr. Yang opposes a stay, he must file a response within 20 days after
he is served.
