The court is in receipt of Plaintiff’s Post-Judgment Application for Amount of Attorney
Fees and Costs. The application includes a request for fees related to a writ of garnishment. In
Blum v. Cowan, 690 Ariz. Adv. Rep 4 (filed July 3, 2014), division two of the Court of Appeals
held that as garnishment actions were created by statute, those actions are governed by statute as
opposed to the terms of the contract. In the absence of a finding by the court that the
garnishment related fees claimed herein were authorized by statute,

IT IS ORDERED denying Plaintiff’s Post-Judgment Application for Amount of Attorney
Fees and Costs.

This order is without prejudice to Plaintiff filing an amended application deleting those
fees deemed by Blum to be non-recoverable; however, absent a showing of good cause, the court
will not award fees attendant with preparation of that amended application.
