Pursuant to the Maricopa County eFiling Guidelines, section 2.09, attorneys shall
electronically file all the documents required to request a default judgment, such as the Application
for Entry of Default, Motion for Entry of Default Judgment, Sum Certain Affidavit, Application
for Attorneys’ Fees when appropriate, and Statement of Costs.
Self-represented litigants are exempt from any mandatory eFiling requirements but may
eFile if they prefer.
Attorneys and Self-Represented Litigants must submit a default judgment packet required
by the Court, including the documents identified on the default judgment packet coversheet in
paper to the assigned commissioner’s division.
A commissioner will not act upon a Motion for Entry of Default Judgment until the
default judgment packet with all the required documents has been received by the division
in paper form.
If the paper packet is not received by the above-named Commissioner division by March
9, 2026, the matter will be dismissed without prejudice for lack of prosecution as to the defaulted
party.

The Court received and reviewed Plaintiff’s “Petition to the Court for Order Releasing
Recorded Lien and Judgment” filed on October 29, 2025. Plaintiff appears to raise a claim of
wrongful recording of a lien. The Court treats Plaintiff’s Petition as a Complaint filed pursuant
to Rule 3.1 of the Arizona Rules of Civil Procedure.
It appears that the Clerk of the Court has issued a summons at the time of Plaintiff’s
filing of the Compliant. Plaintiff is reminded that she must serve Defendant within 90 days from
the date the Complaint was filed.

RULING
The Court has received and reviewed Petitioner’s Petition to the Court for Order Releasing
Recorded Lien and Judgment filed on October 29, 2025, Certificate of Compulsory Arbitration and
Summons.
Review of the “Petition’ indicates that Petitioner seeks quiet title and alleges that a lien was
wrongfully recorded on the property. The Court notes that this Petition is actually a Complaint.
Pursuant to Rule 4(i) of the Arizona Rules of Civil Procedure, Petitioner has 90 days to serve
Defendant with her Complaint, Certificate of Compulsory Arbitration, and Summons.
The Court will take no further action on the pleading until such time as service is complete.
