MINUTE ENTRY
The Court has reviewed Defendants’ Partial Motion to Dismiss (filed February 4, 2013).
It is unopposed, and the deadline to respond (as expanded by the parties’ stipulation) has passed.
Although the Court harbors misgivings about some of the legal arguments presented in the
motion (and in particular, defendants’ arguments about the scope of this Court’s jurisdiction),
plaintiffs’ failure to respond may be deemed consent. Accordingly, pursuant to Rule 7.1(b), the
motion is GRANTED and Counts 1, 3, 6, 7, and 8 are DISMISSED.
ALERT: The Arizona Supreme Court Administrative Order 2011-140 directs the Clerk's
Office not to accept paper filings from attorneys in civil cases. Civil cases must still be initiated
on paper; however, subsequent documents must be eFiled through AZTurboCourt unless an
exception defined in the Administrative Order applies.
