On the Court’s own motion,
IT IS ORDERED setting a Telephonic Status Conference Re: Claimants Wells Fargo
Bank, NA and Tesoro at Grayhawk Condominium Association on July 11, 2018 at 10:15 a.m.,
in this Division. The parties are directed to contact this Division at least five minutes prior to the
hearing to 602-506-3857. All parties appearing telephonically must be joined in a single
conference call and be prepared to hold until called to testify.
The telephone call should be placed from a telephone in an area with no background
noise as this will prevent the parties from hearing the proceedings in the courtroom. The call
may not be placed from a vehicle. Also, the use of cellular telephones to call into the hearing is
strongly discouraged.

10:13 a.m. This is the time set for a Telephonic Status Conference Re: Applications for
Excess Proceeds. Claimant, Wells Fargo Bank, N.A. (“WFB”), is represented by Janessa
Koenig. Claimant, Tesoro at Grayhawk Condominium Association (“HOA”) is present and
represented by counsel, Joseph Hoffman.
A record of the proceedings is made digitally in lieu of a court reporter.
Discussion is held regarding the status of Claimants’ Applications. Counsel for WFB
states that the HOA’s claim has priority over the WFB claim.
The Court notes that the mailing requirements have been met as to both applicants.

The Court has received and reviewed the applications for release of excess proceeds,
supporting documentation, and affidavits of mailing filed by Claimants Wells Fargo Bank, N.A.
and Grayhawk Condominium Association, and grants the pending applications for the reasons
that (1) it has been 180 days from the date that the Complaint was filed in this matter, (2) proper
notice has been given to all interested parties, and (3) no objections have been made and/or any
objections have been resolved.
IT IS ORDERED releasing the excess proceeds to Claimant Wells Fargo Bank, N.A. all
in accordance with the formal written Order Releasing Excess Sales Proceeds to Wells Fargo
Bank, N.A. signed by the Court on July 30, 2018, and filed (entered) by the clerk on July 30,
2018.
IT IS FURTHER ORDERED releasing the excess proceeds to Claimant Grayhawk
Condominium Association, all in accordance with the formal written Order for Release of Excess
